1. Introductory provisions

1.1 This document contains Tåg i Bergslagen’s general Travel Terms and Conditions. These terms and conditions may be updated over time and the latest version of Tåg i Bergslagen’s general travel terms and conditions is available at tagibergslagen.se (“Travel Terms and Conditions”).

1.2 The rights and obligations of passengers travelling with Tåg i Bergslagen are mainly regulated by the Public Transport Passenger Rights Act (2015:953), the Railway Traffic Act (2018:181) (“Järnvägstrafiklagen”) and Regulation (EU) 2021/782 on Rail Passengers’ Rights and Obligations (“Tågpassagerarförordningen”).

1.3 For each agreement regarding train travel with Tåg i Bergslagen entered into between the passenger and Tåg i Bergslagen, Tåg i Bergslagen’s agents and retailers, (the “Transport Agreement”), these Travel Terms and Conditions shall apply unless otherwise agreed. The Travel Terms and Conditions also apply when a means of transport other than train is provided to carry out the agreed journey.

1.4 In the event that applicable law or regulation provides for more favourable terms for the passenger, such terms shall take precedence over what is stated in these Travel Terms and Conditions.

1.5 For safety reasons, children under the age of 7 may not travel unaccompanied on Tåg i Bergslagen. Tåg i Bergslagen does not assume any special responsibility for children travelling alone.

1.6 Tåg i Bergslagen is obliged to transport passengers in accordance with Tåg i Bergslagen’s timetables (including announced changes to these timetables) in return for a fixed ticket price. This obligation applies to the extent that the passenger holds a valid ticket and there is space on the train, and is subject to the restrictions set out in the timetables and in the Travel Terms and Conditions.

2. Tickets, ticket inspection and penalty fees

2.1 Passengers must have a valid ticket before boarding. Passengers cannot buy tickets from staff on board Tåg i Bergslagen. For as long as the passenger is on board the train, they must be able to present a valid ticket when requested to do so. The ticket must be retained throughout the journey.

2.2 Passengers are responsible for ensuring that the ticket is valid and for the correct age category and route/area.

2.3 If, when purchasing their ticket, the passenger is informed through a message at the railway station or otherwise that the ticket must be validated in a machine before boarding, the passenger is considered to not have a valid ticket if such validation has not taken place.

2.4 Passengers using mobile devices as ticket carriers are responsible for ensuring that the mobile device is working (has a charged battery, is compatible with the websites or apps required to display the ticket, etc.). It must be possible to present the ticket on the mobile device throughout the entire journey.

2.5 Tåg i Bergslagen reserves the right to limit the number of passengers on the train for safety reasons or when this is prescribed by law or regulation.

2.6 Seats cannot be booked on Tåg i Bergslagen, but are provided subject to availability. A ticket does not entitle the holder to a seat if no seats are available.

2.7 The tickets that are valid on board Tåg i Bergslagen are set out in Tåg i Bergslagen’s description of the range of tickets at tagibergslagen.se/biljetter. Tickets are available as either personal or impersonal tickets.

2.8 A ticket that is issued for a specific named passenger is personal and is only valid for that passenger. Upon ticket inspection, the passenger must be able to prove their identity by presenting a valid ID document. Valid ID documents are passports, Swedish ID documents, the Swedish Migration Agency’s (Migrationsverket) LMA card and national ID cards within the EU. Accompanying children do not need to present an ID document except in cases where the child’s age needs to be proven.

2.9 Passengers travelling on a discounted ticket must be able to provide acceptable proof of their entitlement to travel at the discounted fare.

2.10 Students travelling on a discounted ticket must be able to prove enrolment on their studies with a valid student ID wit the Swedish Public Transport Association’s (Svensk Kollektivtrafik) student travel symbol and a valid form of ID.

2.11 If the right to travel or discount cannot be proven, the passenger is considered to not have a valid ticket.

2.12 A ticket that has been altered without authorisation is invalid and shall, if possible, be confiscated by the staff on board. Travelling on a counterfeit or falsified ticket is punishable by law and may result in the ticket being withdrawn, the ticket being confiscated and the incident being reported to the police.

2.13 Passengers who cannot present a valid ticket for the entire journey, or cannot present the required documents according to 2.8–2.10, shall be ejected from the train at the next station or be charged a penalty fee, according to the Act on Penalty Fees in Public Passenger Transport (SFS 1977:67).

3. Accessibility

3.1 Passengers with disabilities or impaired mobility have the same rights as other passengers. Special services are provided to make travel accessible to as many people as possible.

3.2 Passengers who have a need for assistance when entering or leaving the train, or when changing trains, are entitled to this at the stations where the assisted travel service is offered. The assisted travel service can be booked via Tåg i Bergslagen’s customer service at least 24 hours before departure.

3.3 To read more about the assisted travel service at stations, passengers are referred to stationsledsagning.se.

3.4 It is permitted to be accompanied by an assistance dog.

3.5 For information about accessibility on board for wheelchairs and mobility scooters, see 10.5–10.10.

4. The passenger’s responsibilities

4.1 The passenger shall monitor and be responsible for all luggage, prams, bicycles, animals and similar that they bring on board.

4.2 The passenger is liable for damage and costs incurred by Tåg i Bergslagen and/or other passengers caused by the passenger or the objects and animals that the passenger brings on board (e.g., luggage, prams, bicycles) by disturbing the order or jeopardising the safety of the operation of the train or otherwise causing damage to the train, onboard staff, other passengers or other passengers’ property. The passenger is also liable for damage caused when objects and animals brought on board by the passenger are placed in such a way that the passenger cannot monitor them.

4.3 In the event that Tåg i Bergslagen becomes liable to compensate another passenger or third party for damage caused by the passenger, or by objects and animals brought on board by the passenger, the passenger shall compensate Tåg i Bergslagen for such costs.

4.4 The passenger is obliged to comply with the Rules of Order when travelling with Tåg i Bergslagen, see section 7.

5. Liability in case of traffic disruption and delay

General

5.1 Delay compensation is regulated according to how far the train travels from the departure station to the destination station, not how far the passenger travels on the train.

5.2 Tåg i Bergslagen’s liability in the event of traffic disruption for trains with a route shorter than 150 kilometres is governed by the Act (2015:953) on the Rights of Public Transport Passengers.

5.3 Tåg i Bergslagen’s liability in the event of traffic disruption for trains with a route longer than 150 kilometres is governed by the Regulation (EU) 2021/782 on Rail Passengers’ Rights and Obligations.

5.4 A journey consisting of several trains with a route shorter than 150 kilometres or trains with a route of 150 kilometres or longer and trains with a route shorter than 150 kilometres is a combined journey if a single ticket has been issued for the journey.

5.5 A single ticket that is valid for several consecutive journeys by train, each with a distance of more than 150 kilometres, is considered as a Through-Ticket. For Through-Tickets, there is an extended right to rebooking and compensation in case of delays and handling of missed connections.

5.6 Journeys involving several of the transport operators that participate in the Resplus scheme and that have been purchased in a single booking are defined as Resplus tickets. In cases where Tåg i Bergslagen is included in a Resplus journey, the Resplus terms and conditions shall apply in addition to Tåg i Bergslagen’s own travel terms and conditions, which includes an extended arrival guarantee, see Resplus terms and conditions at samtrafiken.se/resplus.

5.7 Compensation in accordance with 5.15 and 5.20 can never amount to more than the amount that the passenger paid for the ticket. Holders of period tickets may not, during the period of validity of the period ticket, receive more in total price reductions than the amount that they have paid for the period ticket.

5.8 The passenger is not entitled to a price reduction or compensation in accordance with 5.16 or 5.21 if the delay, missed connection or cancellation was directly caused by or inherently connected with:

  • Extraordinary circumstances that are not connected with the operation of the railway (such as extreme weather conditions, major natural disasters or major public health crises), the consequences of which could not have been avoided or prevented by Tåg i Bergslagen, even if Tåg i Bergslagen had exercised due care that the circumstances required.
  • Errors or omissions made by the passenger (for example, if the passenger misses the departure of the train, boards the wrong train, or does not get off the train at their transfer station or final destination station).
  • The conduct of third parties (such as persons on the tracks, cable theft, onboard emergencies, law enforcement activities, sabotage or terrorism) which Tåg i Bergslagen could not have avoided or prevented the consequences of, even if Tåg i Bergslagen had exercised due care that the circumstances required.

5.9 Compensation cannot be claimed for loss of value, non-material damage or consequential damage.

5.10 Regardless of whether several departures are delayed and/or cancelled in succession, a planned or commenced journey constitutes one (1) delay. Compensation is not payable for partial routes or intermediate stations during the journey.

5.11 Tåg i Bergslagen has the right to request documentation and to investigate the passenger’s claim for compensation. This means that the passenger may need to submit documentation proving that he or she travelled the distance for which compensation is claimed.

5.12 Passengers who are deemed by Tåg i Bergslagen to claim compensation unusually often may need to submit additional documentation. Documentation showing that preparations have been made to make the journey with Tåg i Bergslagen, such as photos showing that the passenger had gone to the departure station. Tåg i Bergslagen will inform the passenger of this, including the date from which it will apply and what type of documentation is required.

5.13 In the event of suspected fraud, attempted fraud or other criminal behaviour, Tåg i Bergslagen may report this to the police.

Trains with a route shorter than 150 kilometres

5.14 If there are reasonable grounds to assume that a journey will be delayed by more than 20 minutes (anticipated delay), the passenger is entitled to compensation for reasonable costs for alternative transport to reach the final destination of the journey upon presentation of a receipt or other equivalent documentation. The maximum allowance is 1/40 of the price base amount in accordance with Chapter 2 Section 7 of the Social Insurance Code (2010:110) that applies for the year in which the journey should have ended. If the passenger has not paid for the trip, the cost that the passenger would have incurred if he or she had paid for the trip is deducted.

5.15 Compensation in accordance with 5.14 is not paid to agents, except for accompanying persons and/or family members.

5.16 If a journey is delayed by more than 20 minutes, the passenger, unless they have requested compensation for alternative transport in the event of an anticipated delay in accordance with 5.14, with the retained right to travel by train, is entitled to a reduction in price amounting to:

  • 50% of the ticket price* for a delay of 20–39 minutes,
  • 75% of the ticket price* for a delay of 40–59 minutes, or
  • 100% of the ticket price* for a delay of 60 minutes or more.

* For those travelling with a period ticket, the amount of the refund is a proportional part of the cost of the period ticket. Information on how the Bergslagskortet ticket price is calculated is provided in 5.27

  • For RKM period tickets, RKM’s rules apply. The passenger should contact the point of sale for compensation in case of delay.

5.17 When compensation in accordance with 5.14 is to be paid in the form of a refund of all or part of the ticket price, the fare reduction shall be calculated for the journey as a whole.

5.18 In addition to what is stated in 5.8, the passenger, when travelling by train with a route shorter than 150 kilometres, is not entitled to compensation if the traffic disruption was known to the passenger through information that had been made public regarding cancelled departure or postponed departure times at least three days before the time of departure shown in the published timetable. However, this does not apply if the time of arrival at the final destination station is stated in the Transport Agreement.

Trains with a route longer than 150 kilometres

5.19 If it can reasonably be expected, either at departure or in the event of a missed connection or cancellation, that the arrival at the passenger’s final destination station under the Transport Agreement will be delayed by 60 minutes or more (anticipated delay), the passenger has the right to choose one of the following:

a) Refund of the full price of the ticket**, under the same conditions as at the time of purchase, for the part or parts of the journey that are not completed and for the part or parts that are completed, if the journey has become meaningless in relation to the passenger’s original itinerary, with a return journey to the first point of departure as soon as possible if this is relevant.

b) Continued travel or rebooking to the final destination as soon as possible and under equivalent transport conditions.

c) Continued travel or rebooking to the final destination at a later date that is convenient to the passenger and under equivalent transport conditions.

If the available rebooking options are not communicated to the passenger within 100 minutes of the scheduled departure time of the delayed or cancelled train or missed connection, the passenger has the right to make their own arrangements for a replacement train or bus journey and to be reimbursed for this, upon presentation of a receipt or other equivalent documentation. The replacement journey must be on comparable terms to the original booked journey. This right only applies after 100 minutes from the scheduled departure time and when rebooking options are not communicated to the passenger.

5.20 If a delay is of 60 minutes or more, or if the connection is cancelled, the passenger is entitled to the following:

a) Meals and refreshments (non-alcoholic) if these are available on board the train or at the station or can reasonably be provided, proportionate to the waiting time, taking into account criteria such as the distance from the supplier, the time required for delivery and the cost.

b) Hotel or other accommodation, and transport between the railway station and the place of accommodation, when a stay of one or more nights or an additional stay becomes necessary, where and if this is physically possible.

c) Transport from the train to the railway station, to an alternative departure point or to the final destination of the service if the train has stopped on the line, where and if this is physically possible.

5.21 If a journey is delayed by 60 minutes or more, unless the passenger has requested a refund in accordance with 5.19a, while retaining the right to travel by train, the passenger is entitled to compensation for the delay in the form of:

  • 25% of the ticket price** for a delay of 60–119 minutes, or
  • 50% of the ticket price** for delays of 120 minutes or more.

** For those travelling with a period ticket, the amount of the refund is a proportional part of the cost of the period ticket. Information on how the Bergslagskortet ticket price is calculated is provided in 5.27

  • For RKM period tickets, RKM’s rules apply. The passenger should contact the point of sale for compensation in case of delay.

5.22 The passenger is entitled to compensation for expenses incurred as a result of traffic disruptions that result in delays from the passenger’s departure station or to the passenger’s final destination station for the train journey with Tåg i Bergslagen, in accordance with the following:

  1. Reasonable additional costs for food and non-alcoholic beverages in case of delay of more than 60 minutes. Reimbursement of expenses is only made for food that can be consumed in connection with travel and that can be consumed without the need for preparation. Purchases of food and drink (non-alcoholic) shall be made in close proximity to the travel.
  • and reasonable additional expenses for accommodation and, if necessary, for transport to the place of accommodation against a submitted receipt if, due to the delay, the passenger has lost the last connecting scheduled service for the day to the final destination station of the train journey with Tåg i Bergslagen, unless the passenger is offered a replacement journey on equivalent terms.
  • If the passenger has been offered free food, drink, accommodation and transport to the place of accommodation in accordance with 5.20, the passenger is not compensated for equivalent costs. Additional costs for food, drink, accommodation and transport to the place of accommodation will not be reimbursed if the passenger cancels their trip.

5.23 Refunds according to 5.19a and compensation according to 5.21 are paid to the passenger within 30 days from the date on which the request is received by Tåg i Bergslagen. Claims for compensation are made in accordance with section 6.

5.24 In addition to what is stated in 5.8, when travelling by train with a route longer than 150 kilometres, the passenger is not entitled to compensation if they have been informed of the delay before purchasing the ticket or if the arrival time has been delayed by less than 60 minutes by continuing the journey with another travel service or rebooking.

5.25 The passenger may request written confirmation that a delay has occurred. To request written confirmation, contact Tåg i Bergslagen’s customer service.

Resplus Arrival Guarantee

5.26 The Resplus Arrival Guarantee (Kom-Fram Garanti) applies to journeys involving several operators that have been purchased in a single booking. The Resplus terms and conditions apply in addition to the operator’s own conditions, see Resplus terms and conditions at samtrafiken.se/resplus.

Calculation of the amount of compensation for the Bergslagskortet

5.27 Compensation in the event of delay is based on an average price per journey. To obtain the average price, the price of the Bergslagskortet is divided by a factor. For the 30-day Bergslagskortet, the factor is 22, and for the 365-day Bergslagskortet, the factor is 264. The amount of compensation is then calculated based on the distance the train travels and the length of the delay in accordance with 5.16 or 5.21. The total delay compensation during the validity of the ticket cannot exceed the purchase price.et 365 dagar är faktorn 264. 6. Customer feedback and applying for compensation

6.1 Information on how to submit customer feedback can be found at tagibergslagen.se/kundservice.

6.2 Application for compensation in the event of delay for travel with Tåg i Bergslagen is made by submitting a form at tagibergslagen.se/ersattning-vid-forsening. In case of a request for reimbursement of additional costs, supporting documents and receipts may be requested.

6.3 Unless there are special circumstances, the application for compensation must be made within 60 days of the date of the delay.

6.4 Passengers who are not satisfied with the assessment of their application may request a review. A request for review shall be made in writing and shall state the reasons for the review. The request for review must be submitted within three (3) weeks of the original decision regarding the application.

7. Rules of Order when travelling with Tåg i Bergslagen

7.1 Passengers are obliged to comply with applicable laws (see in particular provisions of the Railways Act (2004:519) and the Public Order Act (1993:1617)), statutes, norms and regulations during their journey with Tåg i Bergslagen.

7.2 Passengers must comply with signs, announcements and the instructions of the staff on board.

7.3 Passengers must show consideration for other passengers when travelling with Tåg i Bergslagen.

7.4 Passengers shall respect the quiet area and the allergy-friendly area.

7.5 Boarding and alighting may normally only take place at the station. Passengers must follow the instructions of the staff on board if embarkation and disembarkation must take place elsewhere.

7.6 On board Tåg i Bergslagen, it is not permitted to:

  • Smoke or use cigarettes, e-cigarettes, cigars or similar.
  • Drink alcohol.
  • Cook or eat food that might be unpleasant for other passengers.
  • Litter.
  • Lie down on seating furniture, lie or sit on the floor or place feet on the seat.
  • Use radios, music players, mobile phones, musical instruments or similar in such a way as to disturb or inconvenience other passengers or staff on board, or such that other passengers risk not hearing announcements from staff on board.
  • Insult anyone or behave disruptively in any other way.
  • Behave in such a way that another passenger may become concerned that the situation may become dangerous or disrupt traffic order.
  • Open the doors or get on or off the train when the train is in motion.
  • Prevent doors from being closed or opened by force.

8. Loss of the right to travel

8.1 Passengers who, before or during their journey, i) by their behaviour jeopardise or can be feared to jeopardise the safety on board or the operation of the train, ii) are under the influence of alcohol or other intoxicants, iii) disturb the order or disturb other passengers in a way that cannot be accepted, iv) do not comply with the instructions of the staff on board, v) do not comply with section 7, Rules of Order when travelling with Tåg i Bergslagen, vi) do not have a valid ticket for the entire journey, or vii) bring luggage, animals or similar on board that may not be carried in accordance with section 10, have lost their right to travel on the train and may be denied boarding or be ejected from the train at the request of the staff on board.

8.2 A person who has lost the right to travel by train in accordance with 8.1 shall not be entitled to refund of the fare they have paid for the journey or, if the journey has begun, the difference between the fare for the journey and the fare for the distance they have travelled.

9. Filming and photography

9.1 Filming and photography for commercial purposes, sales, interviews, advertising distribution or similar is not permitted on Tåg i Bergslagen without special permission.

10. Luggage and carry-on rules

10.1 The basic rule is that each person may take a maximum of two bags (maximum dimensions 80x50x35 cm, maximum weight 20 kg) and one small piece of hand luggage. In addition, they may take one piece of special luggage, such as a folding pushchair, a ski bag, a golf bag or a musical instrument.

10.2 Luggage must be stored under a seat, on the lap, on the overhead shelf or in another designated place on the train, without inconveniencing other passengers. Luggage may not be placed in such a way as to block escape routes.

10.3 Heavy luggage or luggage protruding from the shelf must not be placed on the overhead shelf.

10.4 Wheelchairs have priority over bicycles, large items of luggage and prams, in that order.

10.5 Luggage that may not be brought on board:

  • Dangerous goods, such as explosive and flammable objects and liquids, and toxic, infectious and corrosive substances.
  • Firearms, unless the bolt or other vital part of the weapon is removed and stored separately from the weapon, which must be kept stored in a case.
  • Other items that may cause inconvenience or discomfort to other passengers or that may cause damage.

10.6 Onboard staff are responsible for safety on board the train and have the right to deny boarding or eject a passenger for safety reasons if the luggage does not meet the requirements above.

Wheelchairs and mobility scooters

10.7 Passengers may bring wheelchairs and mobility scooters (i.e., sit-on scooters) on board provided that the dimensions of the wheelchair/mobility scooter (length/width/weight) are within the thresholds stated below and that Tåg i Bergslagen’s safety requirements are met. If a wheelchair or mobility scooter exceeds the specified dimensions or does not meet Tåg i Bergslagen’s safety requirements, the passenger may be denied boarding for safety reasons.

Maximum dimensions for wheelchairs:

  • Length: 120 cm
  • Width: 70 cm
  • Weight: 300 kg (including passenger)

Maximum dimensions for mobility scooters:

  • Length: 120 cm
  • Width: 70 cm
  • Turning circle: 260 cm (radius 130 cm)
  • Weight: 300 kg (including passenger)

10.8 Wheelchairs/mobility scooters shall be placed in the designated wheelchair space.

10.9 Trains have narrow doors and passages. It is therefore important that the dimensions of the wheelchair are within the permitted thresholds and that the passenger can manoeuvre the wheelchair through narrow passages and on height-adjustable wheelchair lifts.

Prams and pushchairs

10.10 Prams and pushchairs shall be placed in the designated space or folded in the luggage compartment. Where a fastening device for prams and pushchairs is provided, this must be used.

10.11 Prams and pushchairs may not be placed in such a way as to obstruct the passage of other passengers or staff or block the escape route.

Animals

10.12 Passengers may only travel with ordinary pets, such as dogs, cats and rabbits.

10.13 Passengers may not bring animals that may pose a danger or cause discomfort to other passengers or staff.

10.14 Animals are only allowed in compartments or areas with markings that state that animals are allowed (except for guide dogs/assistance dogs).

10.15 Passengers may travel with a maximum of two (2) animals, as long as they fit on the floor next to the seat.

10.16 Small pets, such as birds, rabbits and guinea pigs, count as one animal per cage. The cage must not be larger than normal hand luggage and must be sealed so that the animal cannot escape.

10.17 Cages may be placed on seats as long as the passenger places a protective surface between the cage and the seat. Uncaged animals shall be placed on the floor and may not be on the seat.

Guide dogs and assistance dogs

10.18 Guide dogs and assistance dogs are not considered pets. They are allowed to be in any part of the train, with the exception of the allergy-friendly section. Dogs must be placed on the floor. The dog must also be fitted with a special harness or wear a service blanket that indicates that it is a working dog.

Bicycles

10.19 Subject to space, one (1) conventional bicycle, electric bicycle, electric scooter, kick-bike or stand-up bike (e.g. Segway) per passenger may be carried at no extra cost. Electric scooters with a maximum speed exceeding 20 km/h or a motor power exceeding 250 watts are classified as mopeds and may not be taken on board.

10.20 Fatbikes, tandems, vans, cargo bikes, adult tricycles and bicycle trailers may not be taken on board.

10.21 Bicycles shall be placed in the specially marked space and secured with a special fastening device where available. If all bicycle spaces are occupied or if the bicycle cannot be placed without obstructing the escape route, the passenger travelling by bicycle must wait until the next departure.

10.22 Electric scooters or small folding bikes shall be folded and stored in luggage racks or on the floor under the seat, if space permits. Electric scooters or small folding bikes may not be placed on the overhead shelf. It is not permitted to charge electric scooters or larger lithium batteries on board the train.

10.23 Passengers who travel with a bicycle are responsible for getting their bicycle on and off the train.

Roller skates and skateboards, etc.

10.24 Roller skates, inline skates, skateboards, hoverboards or similar may be brought on board but not used on board the train for safety reasons.

11. Lost property

11.1 Lost property found by a passenger on board Tåg i Bergslagen must be handed in to the onboard staff. No compensation is payable for lost property that is handed in.

11.2 Information on the handling of lost property is available at tagibergslagen.se/kundservice.
